These Terms & Conditions outline the rules, responsibilities, and guidelines for using Star Pay services. By accessing or using our platform, you agree to comply with these terms to ensure secure, fair, and reliable service for all users.
By clicking the "I Agree" checkbox, you acknowledge that you have read, understood and agree to be bound by these Terms and Conditions. If you disagree with these Terms and Conditions do not download or use the Star Pay app.
• "Star Pay" including its successors, assigns, agents, and authorized representatives. For a specific account accessible through the Star Pay Mobile Wallet, "Star Pay" refers to the particular entity offering that account. Please refer to your account agreements and the official website of Star Pay for more information about Star Pay Services.
• "You" or "Your" means each Authorized Person (as defined below) with an interest in a Star Pay account accessible through the Services or the Star Pay Mobile Wallet; each person who signed the application or other binding documentation for the account with Star Pay and any person authorized to use the account in any way (an "Authorized User"). If "You" refers to more than one person your obligations and agreements are joint and several.
• "Account" or "Accounts" refers to the accounts linked to your Tazkira number, Tax Identification Number (TIN), or other unique identifier provided by Star Pay ("Your Identifier") and used through the Services and any other account you add to your Star Pay Mobile wallet profile.
• "Authorized Person" means for an individual account, each person with an interest in or authority to transact business using a Star Pay account. For an entity account it means each person listed as an authorized signatory or otherwise authorized to transact business using such account.
• "Pay Bill" refers to the service that allows you to pay bills to Merchants.
• "Merchant" means the person or entity to whom you wish to make a bill payment, and includes the person or entity from whom you receive goods or services.
• "Billing Account" means your account from which all Service fees will be automatically debited.
• "Business" means the corporation, company, partnership, association or other business that employs an Authorized User (or with which an Authorized User is otherwise associated) and which has arranged for the issuance of a payment card to an Authorized User.
• "Business Day" means Saturday through Thursday, excluding official public holidays in Afghanistan.
• "Star Pay Site" means any website owned or operated by Star Pay that provides information about available products and services, terms and conditions, account information, and transactions that you may view, perform, modify or otherwise access or use while using the Services.
• "Device" means your computer, computer system, mobile device or any other method used to access a Star Pay Site, including all related equipment and software.
• "External Transfers" means monetary transfers between your accounts held at Star Pay and an external financial institution in Afghanistan.
• "Funds Transfers" means all Internal Transfers and External Transfers.
• "Internal Transfers" means monetary transfers between your accounts held at Star Pay to another account in Star Pay.
• "Star Pay Mobile wallet" refers to the Star Pay platforms, including the Star Pay mobile and web app that allow you to perform the Services.
• "Payment Account" or "Eligible Transaction Account" means any transaction account eligible for the Services and designated by you for making payments (including through the Pay Bill service) automatic debiting of service fees and receiving payments and credits.
• "Payment Instruction" means the information you provide for a payment to a Merchant through the Star Pay Service, including the Merchant's name, account number and scheduled payment date.
• "Personal Account" means any asset account established by a natural person primarily for personal, family or household purposes.
• "Agent" means companies (and their affiliates) engaged by Star Pay to provide some or all of the Services on its behalf.
Star Pay and its Agents will maintain the confidentiality of all financial and personal information, documentation, data and know how disclosed by you. Star Pay will not disclose this information to any third party without your prior written consent except:
• As required by applicable law or legal process.
• To protect Star Pay's legitimate business interests.
• To credit information companies’/debt collection agencies for mandated business purposes.
• With your express consent.
Star Pay will not be liable to inform you in advance if your information is required to be disclosed for legal or business purposes but will ensure that only authorized personnel have access to your confidential information and that appropriate security measures are in place to protect such information. Your records will be maintained in compliance with Da Afghanistan Bank rules and regulations.
To enroll in the Star, Pay Mobile wallet you must:
• Be the primary account holder on at least one eligible, unrestricted account.
• Be 18 years of age or older.
• Be an Afghan citizen or must have legal documents for living in Afghanistan (Valid Passport and Visa or other official documents)
• Be legally capable of entering into contracts.
• Register Payment Account(s) in your name or the name of a Business for which you are an account holder or Authorized User.
Star Pay may verify the registration information you provide. If registering for a Business, you represent and warrant that you have the authority to enter into this Agreement on behalf of the Business and yourself and that you will use the Payment Accounts under your obligations to the Business.
After registration you must select the accounts you wish to access through the Star Pay Mobile wallet from the list of eligible accounts provided by Star Pay.
Your ability to transfer funds may be limited by DAB regulations. Refer to your account agreement for details regarding restrictions, service charges and penalties. Transfers made using Star Pay Services count towards your permissible transfer limit. Star Pay may impose a frequency or amount limits on transfers or refuse any transfer, notifying you promptly unless the transfer is prohibited under this Agreement any Additional Agreement or other Star Pay agreements, policies, procedures or DAB rules and regulations.
The External Funds Transfer service allows you to transfer funds to accounts at other financial institutions in Afghanistan. "Inbound Transfers" move funds from an external account to a Star Pay account. "Outbound Transfers" move funds from a Star Pay account to an external account.
Cash in and Star Pay to Star Pay account transfers are currently free of charge. Star Pay will provide notice of any fee changes as required by applicable law. Cancellation of services does not release you from liability for accrued but unpaid fees.
Transfer limits are defined during registration. Daily and monthly limits apply to the total of all transfers for all linked accounts. Star Pay may change your transfer limits at any time according to the changes in related law and regulation. Decreases will be subject to notice if required by law. Star Pay may reduce your limits without prior notice upon the occurrence of a Disqualifying Event, including:
• Any of your Star Pay accounts are not in good standing.
• An item is returned for insufficient funds
• Any Star Pay account during the current or three prior calendar months.
• A prior transfer to or from a non-Star Pay account was canceled, revoked or not completed due to insufficient funds, revoked authorization, stopped payments, frozen account or similar reasons.
Payments include:
• Outgoing Payments (including Bill Pay payments).
• Incoming Payments.
• Funds Transfers.
Funds Transfers are governed by the "Funds Transfers" section.
For Incoming Payments to non Star Pay Payment Accounts, additional terms and conditions of the other financial institution may apply. You are responsible for scheduling payments in time for bills to be paid by the due date. Star Pay may impose a frequency or amount limits on payment requests or refuse any payment, notifying you promptly unless the payment is prohibited under this Agreement.
Pay Bill payments are debited from your Payment Account. By providing payment instructions, you authorize Star Pay (or its Agents) to debit your Payment Account (or request the institution holding the account to do so) and remit funds on your behalf. Star Pay will endeavor to ensure the timely arrival of funds at the designated Biller. You also authorize Star Pay to credit your Account for returned payments or payments remitted to you on behalf of another Authorized Person.
You are responsible for all use of Star Pay services, including of those you authorize to use your account or Device. While Star Pay employs security protocols, it cannot guarantee the prevention of all unauthorized access. If you share access to your Device or Star Pay information, you increase the risk of fraud. Notify Star Pay immediately of any unauthorized use. Star Pay may deactivate some or all Services if it believes the security of your Accounts or Star Pay Wallet has been compromised.
Da Afghanistan Bank the regulator may also deactivate your Star Pay Wallet for security reasons.
To use Star Pay you must:
(1) be legally eligible to have a Star Pay account.
(2) be 18 years of age or older.
(3) be registered with Star Pay and
(4) be a legal resident of Afghanistan.
Star Pay may provide periodic updates to the app.
Your use of Star Pay may be subject to limitations, such as limits on the Afghani currency, amount, or number of transactions within a specific period. Star Pay reserves the right to restrict your access to Star Pay or some or all of its features without prior notice. Star Pay may also decline to process your transaction for risk management purposes.
You agree not to use Star Pay for any purpose other than making authorized transactions. You agree not to:
• Decompile, reverse engineer or attempt to access the source code of Star Pay.
• Use any automated system (robot, bot, screen scraper) to access Star Pay.
• destructively use Star Pay, such as transmitting viruses or exploiting bugs.
• Access Star Pay's services or systems other than as permitted by this Agreement.
• Use Star Pay for any illegal activity (including money laundering, funding terrorism or any other illegal activities).
• Provide false or inaccurate information about yourself or your account.
Information about applicable fees can be found in the Star Pay Fee Schedule available at all Star Pay branches and by calling customer service at [+93-792222222].
You are also subject to all fees, charges, penalties, balance requirements and other restrictions described in your account agreements or other Additional Agreements.
Fees are subject to change. Star Pay may impose additional charges, penalties or fees at any time, subject to these terms. You agree to promptly pay all fees and authorize Star Pay to automatically deduct them from your designated Star Pay Payment Account or any other eligible account.
Star Pay may revise, update, discontinue or modify the Services (including this Agreement the scope of the Services and related materials) or your access to them, temporarily or permanently, at any time.
Star Pay will attempt to provide prior notice of material changes (by posting a notice on the Star Pay Mobile wallet or website, sending a notice to your registered address or sending a secure message) but cannot guarantee it.
Star Pay will also try to provide advance notice of additional transaction fees, stricter transaction limits, or changes to your liability for unauthorized transactions, but cannot guarantee it. Star Pay may make immediate changes if necessary for system security or legal compliance, providing electronic or written notice afterward if possible. Changes to the Services may render prior versions obsolete. Star Pay may terminate this Agreement as to prior versions and limit access to newer versions. Your continued use of the Services after changes constitutes acceptance of those changes. Star Pay may, at its discretion, waive, reduce or reverse charges or fees.
The Star Pay Mobile Wallet Service is generally available 24/7. However, Star Pay may perform maintenance or experience technical issues, resulting in interruptions, delays or errors. Star Pay will attempt to provide prior notice but cannot guarantee it.
Star Pay warrants that its users are authorized on the accounts from which funds are drawn. Star Pay (or its Agent and merchants) will use reasonable efforts to complete funds transfers and bill payments promptly and properly according to your instructions. However, neither Star Pay nor its sub-agents will be liable for any failure or delay in completing a transaction (Outgoing Payment, Incoming Payment or Funds Transfer) if:
• The issue is due to your fault or the fault of your agent (insufficient funds, closed account, exceeding transaction limit).
• The payment processing center is malfunctioning (and you were aware of it).
• You did not follow instructions properly.
• You provided incorrect information.
• You did not authorize a payment in time.
• A timely payment is not credited promptly by the Biller.
• Withdrawals are prohibited by court order.
• Star Pay reasonably believes a transaction may be unauthorized.
• Your Device or related system malfunctioned.
• A Force Majeure event (computer failure, telecommunication outages, natural disasters, acts of terrorism) prevents the transaction.
• Any other circumstances outlined in this or other agreements.
You authorize Star Pay to collect, use and disclose your information to third parties (auditors, consultants, DAB, FINTRACA, attorneys and any other body assigned by court or regulator) consistent with the Star Pay Privacy Policy.
Account information provided through Star Pay is not the official statement of record. Your periodic statement is the official record. You are responsible for reviewing all statements and account communications.
You are solely responsible for maintaining accurate and current contact information in your user profile, including your full name, Tazkira/ Passport and Visa number, current and permanent address, phone numbers, email addresses, account numbers and other information required by DAB KYC guidelines. Star Pay is not responsible for errors, charges or fees resulting from inaccurate information.
If you close your Star Pay Account, you must notify Star Pay and provide a new Payment Account. If you close all your Star Pay accounts, you must notify Star Pay to cancel your Services.
Star Pay may send you periodic statements. You are responsible for promptly reviewing these statements and notifying Star Pay immediately of any suspected unauthorized transactions, compromised passwords or fraudulent activity.
You can call Star Pay at [+93-792222222] 24/7 or visit a Star Pay official branch and website. Prompt notification can help reduce potential losses. You agree to assist Star Pay in recovering any unauthorized funds.
This Agreement is subject to the Star Pay Privacy Policy. You acknowledge that Star Pay does not control data transmission over telecommunications networks and that the Internet is inherently insecure. You agree to:
• Only disclose necessary Personal Data to Star Pay.
• Implement appropriate privacy and security safeguards.
• Protect your passwords and change them regularly.
• Not transmit data for unlawful purposes.
• Cooperate with Star Pay's compliance efforts.
• Notify Star Pay of any limitations or restrictions on the use or disclosure of Personal Data.
Star Pay may use and disclose transaction and system information for providing the Services, related products and services, product enhancements, research and development and (in aggregated form) for analytics, commercial and benchmarking purposes.
This Agreement is subject to the Star Pay Privacy Policy. You acknowledge that Star Pay does not control data transmission over telecommunications networks and that the Internet is inherently insecure. You agree to:
• Only disclose necessary Personal Data to Star Pay.
• Implement appropriate privacy and security safeguards.
• Protect your passwords and change them regularly.
• Not transmit data for unlawful purposes.
• Cooperate with Star Pay's compliance efforts.
• Notify Star Pay of any limitations or restrictions on the use or disclosure of Personal Data.
Star Pay may use and disclose transaction and system information for providing the Services, related products and services, product enhancements, research and development and (in aggregated form) for analytics, commercial and benchmarking purposes.
This Agreement is governed by the laws of the Islamic Emirate of Afghanistan. Any controversy or claim arising from this Agreement will be resolved by arbitration before a sole arbitrator in Kabul, Afghanistan, according to the current Commercial Rules of the Islamic Emirate of Afghanistan and DAB/NBFI Mobile Wallet Solutions guidelines.
The arbitrator's award will be final and binding, and enforceable in any court of competent jurisdiction, but will be limited to damages consistent with this Agreement. Each party will bear its legal fees and costs. This arbitration clause does not apply to claims for intellectual property infringement.
